ARTIFICIAL INTELLIGENCE AND COPYRIGHT – THE APPROACH OF LAW AND ECONOMICS: THE CASES OF TÜRKİYE, GERMANY AND HUNGARY

The rise of artificial intelligence (AI) has brought rapid and ongoing changes, raising important legal and economic questions. AI is typically defined as systems or machines that imitate human intelligence and improve through data. With the development of autonomous generative AI, which creates original content using machine learning, intellectual property (IP) law is facing new challenges. These AI systems can produce artistic works based on human-provided data, affecting the creative industries significantly. IP rights protect the moral and financial interests of creators, encouraging innovation. However, a major legal debate has emerged over whether AI-generated works can be protected under current copyright laws, which are traditionally human-centered. This situation calls for an evaluation of existing legal frameworks to determine if they can accommodate the unique nature of AI-generated content.
