Análise comparativa de sistemas de IA para suporte à decisão judicial: Aplicabilidade no Tribunal de Justiça da União Europeia

This article focuses on the role of Artificial Intelligence, hereinafter AI, in the context of justice, with a special focus on the Court of Justice of the European Union (CJEU). It begins with the evolution of AI and its increasing application in judicial systems, analyzing several international examples of the use of this technology, namely in procedural triage, document analysis, decision support, and outcome prediction. The concept of predictive justice is also analyzed, highlighting its potential. With regard to the CJEU, the article highlights the increase in the volume of cases, the average duration of proceedings, and the high number of pending cases, underlining the relevance of the principle of procedural speed in the European context. It concludes that AI could be a relevant instrument for the modernization of justice, especially in areas such as legal research, case law analysis, translation, anonymization, and decision support. Its integration, provided it is carried out responsibly and in accordance with fundamental legal principles, can contribute to greater efficiency and speed in judicial proceedings.
